Kippal Vacation Rentals: House Rules & Agreement

Welcome to Kippal! These Terms and Conditions ("Agreement") are our house rules. They form a legally binding agreement between Kippal (the "Company," "We," "Us," or "Kippal") and you, the Guest (the "Guest," "You," or "Renter"), for your stay at the beautiful Property (the "Property") identified in your Booking Confirmation. Think of this as the friendly, but essential, guide to a great stay.

1. Definitions

  • Company/Kippal: Refers to the vacation rental business operating under the name Kippal.

  • Guest/Renter: The individual who places and pays for the booking, who must be at least 25 years old.

  • Property: The specific vacation rental unit, including all associated amenities, listed in the Booking Confirmation.

  • Booking Confirmation: The email or written notification sent by Kippal confirming the reservation, detailing the Property, Rental Period, Total Rental Fee, and Security Deposit.

  • Rental Period: The specific dates of the Guest's stay, from the Check-in Time to the Check-out Time.

  • Total Rental Fee: The sum of the rental charges, applicable taxes, cleaning fees, and any other agreed-upon charges.

  • Security Deposit: The refundable amount held by Kippal to cover potential damage, excessive cleaning, or policy violations.

2. Booking and Payment

2.1. Reservation

A reservation is confirmed only upon (a) receipt of the initial deposit (or full payment if booked close to the stay date) and (b) issuance of the Booking Confirmation by Kippal.

2.2. Deposit and Payment Schedule

  • Initial Deposit: A non-refundable deposit of 30% of the Total Rental Fee is due at the time of booking.

  • Final Payment: The remaining 70% of the Total Rental Fee, plus the Security Deposit, is due 60 days prior to the Check-in Date.

  • If the booking is made less than 60 days prior to Check-in, the full Total Rental Fee and Security Deposit are due immediately.

2.3. Failure to Pay

Failure to remit the final payment by the due date will result in the automatic cancellation of the reservation without notice, and the initial deposit will be forfeited.

3. Cancellation and Refunds

All cancellation requests must be made in writing via email to Kippal.

  • Cancellation 60 or more days before Check-in: The Guest will receive a refund of all monies paid, excluding the initial non-refundable deposit.

  • Cancellation between 30 and 59 days before Check-in: The Guest will receive a 50% refund of the total amount paid (excluding the initial deposit).

  • Cancellation less than 30 days before Check-in: No refund will be provided.

  • Early Departure: No refunds will be given for early departure or non-arrival.

We highly recommend that Guests purchase travel insurance to protect against unforeseen circumstances requiring cancellation.

4. Check-in and Check-out

4.1. Check-in

The standard Check-in Time is 4:00 PM on the arrival date specified in the Booking Confirmation. Guests are responsible for adhering to the provided instructions for key collection or keyless entry.

4.2. Check-out

The standard Check-out Time is 10:00 AM on the departure date specified in the Booking Confirmation. Guests must vacate the Property and return all keys/fobs by this time.

4.3. Late Check-out Penalty

Unauthorized late check-out will result in a penalty fee of $50 for every hour after 10:00 AM, up to the full nightly rate. This is necessary to prepare the Property for the next arriving Guest.

5. Security Deposit and Damages

5.1. Purpose and Hold

The Security Deposit is held against any damages to the Property or its contents, excessive cleaning required after departure, or breach of these Terms and Conditions.

5.2. Return

The Security Deposit will be returned to the Guest within 14 business days following the Check-out Date, provided:

  • No damage has been caused to the Property, its contents, or common areas.

  • No items are missing.

  • The Property is left in a reasonably clean condition (i.e., dishes cleaned, trash bagged).

  • All keys and access devices are accounted for.

5.3. Damage Charges

If damages exceed the amount of the Security Deposit, the Guest authorizes Kippal to charge the credit card on file for the remaining balance. Kippal will provide documentation of all damage costs incurred.

6. Guest Responsibilities and Property Rules

The Guest agrees to abide by the following rules throughout the Rental Period:

6.1. Maximum Occupancy

The number of persons occupying the Property shall not exceed the maximum occupancy limit specified in the Booking Confirmation. Violation of this rule will result in immediate termination of the rental agreement and forfeiture of all fees.

6.2. Noise and Disturbances

Guests must respect the neighborhood and neighboring properties. Quiet hours are from 10:00 PM to 8:00 AM. Excessive noise, parties, or unlawful activities are strictly prohibited and will result in immediate eviction without refund.

6.3. Smoking

Smoking is strictly prohibited inside the Property. Any evidence of smoking indoors will result in a minimum penalty fee of $500 charged against the Security Deposit for remediation and deep cleaning.

6.4. Maintenance and Repair

The Guest must notify Kippal immediately of any Property maintenance issues, equipment malfunctions, or needed repairs. Kippal will make commercially reasonable efforts to resolve the issue as quickly as possible. No refunds will be provided for maintenance issues, loss of power, water, or internet access that are beyond the Company's control.

6.5. Use of Amenities

The Guest uses all amenities, including pools, hot tubs, and barbecue grills, at their own risk. Children must be supervised at all times.

7. Indemnification and Liability

The Guest agrees to indemnify and hold harmless Kippal, its employees, and the Property Owner from and against any and all liabilities, claims, losses, damages, costs, and expenses (including attorney's fees) arising from the Guest’s occupancy, including but not limited to:

  1. Any injury or damage suffered by the Guest or invitees on the Property.

  2. Any damage caused by the Guest or invitees to the Property or neighboring properties.

  3. Any breach of these Terms and Conditions by the Guest.

Kippal is not responsible for the loss or damage of the Guest’s personal property.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Quintana Roo, Mexico where the Property is located, without regard to its conflict of laws principles. Any legal action arising from this Agreement shall be filed in the courts of Cozumel, State of Quintana Roo, Mexico.
